Complaint for a Litter Abatement Order

Defendant:  Secretary Of State  Transport Lord (Andrew) Adonis

Matter of complaint:  That the complainant is aggrieved by the want of cleanliness of that part of the M40 between the border with Greater London and Junction 4 (High Wycombe) with particular reference the areas between the road surface and the borders with the adjacent land.

that the defendant has a duty to keep the said highway clean under section 89(2) of the Environmental Protection Act 1990]

and the complainant now therefore makes application to the Court to make a Litter Abatement Order pursuant to section 91(6) of the Environmental Protection Act 1990, requiring the defendant to clean the said highway.
